Coverfly Data Use and Protection Policy

 

What Data and Why We Collect It

We collect the following data and information to provide Coverfly’s Services, as well as improve the experience of our Services for our users:

Your account data. When you sign up for your Coverfly account, we collect data about you and your projects. Some of our Services let you connect your accounts and import your information from other service providers.

Your Project Info. Our Services are dedicated to making it easy for you to store and view your project files, project descriptions, scripts, media, narrative works, documents, evaluations, scores, and so on (“Your Project Info”), as well as optionally share some of your Project Info with industry professionals. To make that possible, we store, process, and transmit Your Project Info, and data related to it. If we ask for sensitive information, such as your gender, race, nationality or sexual-orientation, this information collection will be completely optional and it will be used only if you opt to include it on your profile or in connection with your projects (for instance if you want it to be visible to producers who are seeking a diverse writer or filmmaker).

Your Usage information. We collect data related to the ways you use the Services, such as actions you take in your account (like updating, editing, sharing, messaging). We use this data and information to improve our Services, develop new features, protect Coverfly users and provide value to our users.

Device information. We may also collect information from and about the different devices you use when you access the Services. This information may include the browser type, IP addresses, the referral website or web page you visited before visiting our websites, and unique identifiers associated with your devices. Your devices (depending on the device settings) may also send location information to the Services.

Cookies and customer data tracking technologies. We may use technologies like pixel tags and cookies to improve, provide, and promote our Services or the security of our Services for all users. You can adjust your browser settings to not accept cookies, however this could limit your ability to use the Services. 

Payment information. For convenience, when purchases are made through Coverfly, we may save a tokenized reference to your credit card information on Stripe, a third party credit card processing service. Coverfly will never share this information with a third party or charge any customer without their explicit consent.

Marketing and 3rd Party Promotions. We offer users the option to use some of our Services free of charge. These free Services may include optional free hosting for Your Project Info in Coverfly’s industry-facing database (should you choose to do this). If you register for our free Services, we may, from time to time, send you information and promotions about upgrades when available, or relevant promotions from third parties. Any user who receives this promotion can opt out of the email list at any time. If you do not want to receive marketing materials from us, you can simply click the ‘unsubscribe’ link at the bottom of any email from us, or update your preferences in your Coverfly account settings.

Coverfly is a data “controller” (we determine how to use and process the data of our users who create Coverfly accounts), and Coverfly is also a data “processor” which processes personal data on behalf of Coverfly’s partner organizations (contests, festivals and fellowships which manage their submissions using the Coverfly software).

Reasons for processing your data. We collect and use the information described above so that we can provide you with our Services in a reliable, secure and useful manner in accordance with generally accepted best practices, on a lawful basis and in compliance with the EU’s GDPR (General Data Protection Regulation) and other applicable regulations. To the extent that we may process your personal information for other purposes, we will ask for your consent beforehand or require that our partners obtain such consent explicitly from you.

With Whom Your Information May Be Shared

We may share some data about you, but we won’t sell your data to third parties or advertisers.

Coverfly uses some trusted third parties (for example, providers of data storage, IT services and customer support) to help us improve, provide, protect, and promote the Services. These trusted third parties will access your data and information to perform tasks only on our behalf in compliance with our Privacy Policy, and we remain responsible for the handling of your information. Our trusted third parties that may process your information on our behalf and in order to provide our Services include the following services, and this list may be updated from time to time: Amazon Web Services, Stripe, Paypal, Google Drive, Gmail, FreshDesk, MailChimp, Drip, WriterDuet and Microsoft. Additionally, organizations’ script readers and judges may use third party software and devices such as to display and read screenplays as well as Your Profile Information.

Our Services may display information such as your name, profile information, project title, logline, description, and messaging to other users in places like your user profile and email notifications. You can also share Your Project Information with other users if you choose. When you submit your project to a third party contest, festival or service which uses Coverfly as a submissions management platform, Your Project Info may be updated, amended and imported into your Coverfly account per your agreement with the third party contest or service to which you submitted your project. This helps you sync all of Your Project Info and data in one place, which is part of Coverfly’s Services to its users.

Stewardship and protection of your data is very important to us. We believe that your data should receive legal protection wherever you choose to store it, and we are committed to managing your data with careful attention and respect for your rights and privacy.

How You Can Manage Your Data

Security. Our team is dedicated to keeping your data safe and secure. We choose our third party data-processing partners very carefully, working with only the industry-leading technology partners and service providers. We deploy technology to detect suspicious or abusive activity and behavior that may harm our Services, you, or other users.

User Control of Data. You can access, edit and delete your personal information by logging into your Coverfly account and going to your account settings page.

Retention of Data. When you create your Coverfly account with us, we will retain information you store with our Services for as long as your account is in existence. If you delete your account, we will initiate total deletion of this data within 60 days or less. But please note that there may be some latency in deleting some information from our servers due to our automated back-up storage processes.

Where your data will be stored and processed

Worldwide. To provide you with our Services, we may store, transmit, and process information in the United States and locations around the world—including those outside your country of residence. Information may be stored locally on your devices you use with the Services.

Coverfly is subject to law of the United States of America and oversight by the U.S. Federal Trade Commission.

Changes in ownership

If Coverfly or its parent company, Red Ampersand, LLC, were to be involved in a merger, sale of assets, or acquisition, your data may be transferred as part of that deal. We will notify you of any such deal and offer you choices for how you want to handle your data in that event.

We may revise this Policy from time to time. The most current version will be clearly available at all times on our website, with a link in the footer of the home page.

Your Rights

You have the right to control your data and how it’s used. You have a right to:

  • Erase or delete all or some of Your Project Info in your Coverfly account.
  • Change or amend personal information. You can manage your account and edit some of your personal data, through your account settings page.
  • Access and move your data. You can download a copy of Your Project Info in a machine readable format by sending an email request to support@coverfly.com and one of our staff will respond within 5 business days.
